AME (Agreed Medical Evaluator)
An AME is a board-certified dermatologist jointly selected by both the applicant’s and defense attorneys to evaluate an injured or ill worker. The AME provides expert opinions on causation, permanent impairment, apportionment, and anticipated future medical needs.
Benefits for Attorneys and Applicants
- Appropriate when both parties are represented
Used when the applicant and defense agree on a single, neutral evaluator. - Authoritative medical opinions
AME findings carry substantial legal weight, making thoughtful selection essential. - More efficient case resolution
The AME process helps reduce prolonged litigation and supports a more streamlined path to resolution.
QME (Qualified Medical Evaluator)
QME (Qualified Medical Evaluator)
A QME is a board-certified dermatologist certified by California’s Division of Workers’ Compensation to perform impartial evaluations when the parties cannot agree on a medical opinion. QMEs are selected from a specialty-specific panel and are commonly used when applicants are unrepresented.
Benefits for Attorneys and Applicants
- Access to independent, specialty-specific opinions
Provides objective medical evaluations when agreement on an evaluator is not possible. - Key role in benefit determinations
QME findings significantly influence workers’ compensation benefits and settlement outcomes. - Standardized, state-regulated process
Panel selection and reporting follow established California guidelines for consistency and fairness.
IME (Independent Medical Evaluation)
IME (Independent Medical Examination)
An IME is a medical evaluation performed by a physician who has not participated in the patient’s treatment, providing an objective assessment of the individual’s medical condition. IMEs operate outside the oversight of California’s Division of Workers’ Compensation and are subject to fewer procedural regulations than QMEs and AMEs.
Benefits for Attorneys and Applicants
- Objective, independent medical opinions
Provides unbiased evaluations to support or challenge medical and legal claims. - Clarifies key clinical and legal questions
Addresses causation, treatment necessity, and functional capacity. - Supports informed case decisions
Guides determinations related to disability, liability, and insurance matters.
SIBTF (Subsequent Injuries Benefits Trust Fund)
This state-administered fund provides compensation to injured workers who had a pre-existing disability and then sustain a work-related injury that increases their overall impairment. DermLegal connects attorneys with AMEs and QMEs experienced in evaluating claims involving the Subsequent Injury Benefits Trust Fund across relevant specialties.
Benefits for Attorneys and Applicants
- Expands access to additional compensation
Supports recovery for workers with significant combined disabilities. - Reduces employer liability exposure
Helps promote equitable hiring by limiting responsibility for pre-existing conditions. - Requires precise, multi-specialty evaluation
Involves comprehensive documentation and coordinated medical assessment.
Department of Labor Cases
Medical evaluations for federal employees injured in the course of duty are governed by the Office of Workers’ Compensation Programs. These matters often involve complex documentation and strict reporting requirements. DermLegal supports attorneys and applicants by coordinating dermatology evaluations that meet federal standards for approved conditions and ongoing care.
